Court dismisses APC’s request to investigate court registry in Benue
The Benue State High Court in Makurdi, on Wednesday, turned down a request for an investigation into the Court Registry.
As a result, the court scheduled the hearing of all remaining applications and the substantive suit for October 30, 2024.
The application filed by the All Progressives Congress, APC, sought the court’s order to compel the Registry to examine the alleged presence of Counsel’s signature on the Originating Motion No. MHC/1587M/2024 and to halt proceedings until the results of the inquiry were known.
In ruling on the motion, Justice Kume determined that proceeding with the instant motion would unfairly prejudice the pending Preliminary objection to the suit’s competence, which shares similar grounds and effects.
The legal team of Benue State Chairman of APS, Austin Agada, represented by F.A. Nomor, who was accompanied by several lawyers, requested an adjournment to review the processes served on him in court.
S.D. Swem Esq, who was advocating for Matthew Burkaa SAN, and Basil Hemba Esq, who was advocating for Dikko, SAN, did not oppose the ruling.
